Welcome to PixElect.in (hereafter referred to as "Pixelect", "Platform", "we", "our", or "us"). By creating an account, accessing, or utilizing our software, client galleries, CRM, or microservices, you (whether as a "Photographer", "Studio Admin", "Client", or "Guest") agree to be bound by these Terms & Conditions. Please read them thoroughly.
💼 1. Eligibility & Account Responsibility
To use Pixelect, you must be at least 18 years of age and capable of entering into legally binding contracts under the Indian Contract Act, 1872. You are solely responsible for maintaining the confidentiality of your credentials, studio password, and client PINs. Any activity executed under your account credentials remains your legal responsibility.
📸 2. Description of Platform Services
Pixelect provides automated digital workflow solutions tailored for wedding photographers and creative studios, including:
- High-speed web preview generation and watermark embedding
- PIN-protected client photo selection via responsive mobile web links
- Desktop 1-click RAW photo matcher and direct local copy scripts
- 3D interactive digital virtual photobooks with audio accompaniment
- PixEvent AI: QR-based real-time selfie face-matching for live event guest photo delivery
- Studio billing, advance management, and automated WhatsApp invoices
⚖️ 3. Intellectual Property & Content Ownership
- Photographer Ownership: You retain 100% full copyright and ownership of all photographs, logos, and media uploaded to Pixelect. We do not claim any ownership rights over your creative works.
- Limited License to Operate: You grant Pixelect a strictly limited, non-exclusive, royalty-free license solely to host, cache, convert, and display previews to your designated clients for proofing and selection.
- Warranties: You warrant that you have obtained all necessary model releases and consent from wedding couples, subjects, and copyright holders before uploading media.
🗄️ 4. Storage, Data Retention & Local Backup Responsibility
Critical Notice on Primary Storage:
Pixelect is an active client photo selection, proofing, and delivery pipeline — NOT a permanent cold archival backup service.
Photographers are required to retain permanent primary copies of all camera RAW files, high-resolution masters, and finalized albums on their local physical drives. Pixelect stores lightweight web previews for the duration of the selection project and active subscription. Following project completion or subscription lapse beyond the designated grace period, preview files may be purged to free cloud capacity.
🤖 5. PixEvent AI & Facial Recognition Terms
When utilizing PixEvent AI for live event guest delivery:
- Guests upload a selfie via QR code solely to match their appearance against photos taken at that specific event.
- Facial vectors are computed transiently in memory for same-event clustering and are strictly never used for public surveillance, cross-event tracking, or training external machine learning models.
- Studios enabling PixEvent AI warrant that event organizers have notified attendees regarding AI photo retrieval availability at the venue.
💳 6. Subscriptions, Fees & Commercial Terms
- Subscription plans are billed in advance on recurring monthly or annual schedules via authorized payment gateways (UPI, Cards, Net Banking).
- Applicable Goods and Services Tax (GST) is levied in compliance with Indian statutory regulations. GST invoices are generated upon successful payment.
- Pixelect reserves the right to revise pricing plans with prior notice to active users before the commencement of subsequent billing cycles.
🤝 7. Intermediary Status & Studio-Client Relationship
Pixelect operates solely as an intermediary SaaS technology provider as defined under Section 79 of the Information Technology Act, 2000. The commercial contract for wedding photography, physical album manufacturing, pricing, and photo delivery deadlines is exclusively between the Studio and their Client. Pixelect is not a party to those bilateral contracts and assumes zero liability for commercial disputes between studios and couples.
🛡️ 8. Limitation of Liability
Pixelect is provided on an "as-is" and "as-available" basis without warranties of uninterrupted uptime. To the maximum extent permitted under applicable law, Pixelect shall not be liable for any indirect, punitive, incidental, or consequential damages, loss of business profits, or hardware malfunctions. In all events, Pixelect's aggregate cumulative liability shall not exceed the total fees paid by the user in the three (3) months preceding the claim.
🏛️ 9. Governing Law & Jurisdiction
These Terms and Conditions shall be governed by, interpreted, and enforced in accordance with the substantive laws of the Republic of India. In the event of any legal dispute, controversy, or claim arising out of or relating to these Terms or the use of Pixelect, the parties irrevocably submit to the exclusive jurisdiction of the competent Courts situated in Kolkata, West Bengal, India.
